Attorneys on the Texas REALTORS® Legal Hotline (512-480-8200) can help you with all manner of real estate legal information. What they cannot do, however, is give legal advice.
What’s the Difference?
Legal advice is a statement that recommends a course of action or interprets the law based on your or your client’s specific circumstances. Legal information is a statement that provides public information, such as rules or laws, or can be an explanation of those rules, terms, or forms.
Here are two examples:
- Legal advice: “The listing agent says the last day of the option period is today, but I think it ended yesterday. Who is right?”
- Legal information: “How do I count the days to determine the deadline for my client’s termination option?”
Who Can Give Legal Advice?
If you want legal advice, you must hire your own attorney. Texas REALTORS® legal staff provides legal information that is not intended and should not be considered legal advice.
Thank you! I always read the posts involving anything regarding forms or legal issues!
Is it legal for a realtor to refer a new home owner to a mortgage protection life insurance broker? The expectation is that the realtor will receive a portion of any commission the insurance broker generates from such a lead as a finders fee.
The assumption here is the realtor is referring a client to the insurance broker when the new home owner has expressly stated they are interested in mortgage protection.
The new lease was signed but no deposits were made by the tenants. No deposits or prorated rent. Its passed the due date.
No keys were handed over to the tenants. Tenants never occupied the property.
Is this lease still valid?
Does the executed date of an amendment to extend the closing date supercede the executed date of the 1-4 contract?
If a buyer defaults on the closing date, can the seller submit a termination of contract and keep the earnest money?
How do you have your home removed from MLS Listing if the broker you hired is will not?
