No. Under the Centers for Disease Control and Prevention’s order, tenants who want to be protected from eviction must provide a declaration to their landlords, owners of the residential property where they live, or other people who have a right to have them evicted.
The order, which is in effect from September 4 through December 31, 2020, prohibits a landlord, owner of a residential property, or other person with a legal right to pursue eviction from evicting any covered person for nonpayment of rent. A covered person is a tenant, lessee, or resident of a residential property.
And you’d think the writer would define what a “covered person” is, in the article itself.
It does.
So basically, you cannot really evict anyone. How is the declaration done? Verbal? In writing? In writing and notarized? E-mail? What?

I’m a bit confused…my tenant hasn’t paid any rent since start of March eviction moratorium. Am I entitled to file for eviction at this time if tenant hasn’t provided me with this declaration?…or…does this mean landlords can file to evict a tenant for ANY OTHER legal reason (providing the tenant hasn’t furnished the declaration), with the only exception for nonpayment of rent through December? I’m also assuming this declaration is applicable for all U.S. states.
As I understand it, you should go ahead and file for eviction. If the tenant does not file the declaration, they should be evicted. If they do file it, you are out of luck as I understand it.
Even though the declaration stipulates they be paying monthly towards their rent owed-ours didn’t and I tried to argue it but got shot down. Everything is on the tenants side. This is being abused!
I am sooooo happy that us rich multiple property landlords (with mortgages) are able to subsidize tenants because …well, because we’re stinking rich, right? This is what happens when government is allowed to pick winners and losers. Nice to know my family and my business doesn’t matter to the politicians until it’s election time and they want donations and my vote.

Our tenants haven’t paid anything since September 9 and they are protected until December 31!?!?
As of December 1, They are over $7,000 behind. Why no relief for us landlords??
